David R. Oberlander
David R. Oberlander represents residential, commercial, office and industrial developers in securing a wide range of development approvals and in development related litigation. He regularly appears at planning and zoning boards throughout New Jersey and has extensive experience challenging denials and development restrictions in trial and appellate courts. He has experience in affordable housing law and has litigated numerous builder's remedy cases which have resulted in court ordered rezoning permitting increased development. Mr. Oberlander also litigates development issues before various State administrative agencies including the Department of Environmental Protection (DEP), the Council on Affordable Housing (COAH) and the Board of Public Utilities (BPU).
Mr. Oberlander has lectured on land use matters for the New Jersey Institute of Continuing Education and for the New Jersey Builders Association. He has long been active in community and legal affairs and has held the following positions:

- Solicitor, Township of Cherry Hill Zoning Board of Adjustment (1987-1990)
- Secretary, Supreme Court of New Jersey, District IV Ethics Committee (1995-1996)

- Solicitor, Greater Cherry Hill Chamber of Commerce (1986-1993)
- Elected Member, Cherry Hill Board of Education (1996-2005)
- President, Durand Academy (1986-1996)
- Member, Jewish Community Relations Council (2007-Present)
Following law school, Mr. Oberlander clerked for Superior Court Judge Warren C. Douglas. He was subsequently a partner in two mid-size Cherry Hill firms before joining Bisgaier Hoff at its formation in January 2010.
Mr. Oberlander is licensed to practice law in New Jersey and Pennsylvania.
Representative Matters
- Securing all land use approvals for numerous substantial utility projects, including a $200 million regional water supply facility.
- Securing land use approvals for several New Jersey facilities for a Fortune 500 retailer.
- Obtaining a judgment, after an 18-day trial, upholding a developer's right to construct a 130 unit inclusionary housing complex, and successfully defending that judgment on appeal.
- Serving as co-counsel in successful court challenges to the Third Round regulations of the Council on Affordable Housing.
- Representing buyers and sellers of land and developed properties.
- Negotiating redevelopment agreements and successfully challenging unwanted redevelopment designations.
- Prosecuting appeals of real estate tax assessments resulting in reductions of up to $13 million.
